Code of conduct

Take-Home Examination Law & Practice 2019-2020 Quarter 1 This take-home examination will be released on Wednesday, October 30, 2019 on Blackboard. The examination is open book. You may consult any materials that you deem appropriate to complete the exam. Your code must be drafted in your own words. Any sources used as inspiration should be cited at the back of the manual in a bibliography. Testing objective: This take-home examination will assess your ability to (i) draft an ethically sound code of conduct/employee handbook section that (a) defines and (b) sanctions undesirable conduct in the workplace and (ii) provide a procedure for investigation and sanctions. The sources used to develop the product must be provided in a bibliography at the end of the document. Instructions: Draft a Code of Conduct or Employee Handbook for an organization (choose either a non-governmental organization, international court or a law firm and indicate in the document which type of organization your rules apply to). The handbook must address the main undesirable behavior (including those discussed in Seminar 3) currently prescribed in todays organizations by: (1) defining each undesirable act (35 points); (2) describing the penalty/(ies) for such behavior (20 points); and (3) providing a step-by-step procedure for investigation of and sanctioning of such undesirable behavior (40 points). Cite any sources consulted or used as inspiration for drafting at the end of the code/manual in a bibliography (5 points). ? Grading Rubric Definitions 35 points o The professional product contains definitions for the common undesirable behavior identified in todays workplace (10 points) o The professional product defines each act and indicates examples of such undesirable behavior (20 points) o The professional product uses consistent terminology, employs proper use of grammar and spelling, and is written in standard, professional English (5 points) Penalties/Sanctions 20 points o The professional product outlines the penalties for each type of undesirable behavior (5 points) o The professional product describes different levels and severity of penalties that address the gravity and number of undesirable acts by an employee (10 points) o The professional product uses consistent terminology, employs proper use of grammar and spelling, and is written in standard, professional English (5 points) Investigation and Sanctioning Procedures 40 points o The professional product describes the method and procedure for investigations of alleged violations (25 points) o The professional product indicates the manner in which sanctions are applied and the length of such sanctions, if applicable (10 points) o The professional product uses consistent terminology, employs proper use of grammar and spelling, and is written in standard, professional English (5 points) o Bibliography 5 points The bibliography properly identifies the author, title and location of the source by using a citation that conforms with the OSCOLA (4th Edition) rules for bibliographies (5 points)
