McDowell Kim V. Robinson Renard

This is paper is an observetional report . It is based on a superior court case (civil) at the Cobb judicial Circuit in Marietta. T courtroom 6100 with the honorable Judge Green on the 6th floor. Case NO. 18105187 and their previous court date was on 8/05/2019. Here are the questions that need to be answer throughout the paper. For the ” what you bring to the table” part I want it to be about my parents living in different countries and how difficult it is to get used to their different lives. At the I have to connect the dots with what I bring to the table and what the case is about so if you think you got a better idea about a family being separated, I don’t mind you writing about it instead. This case is a civil case, dispute over two parents that got divorced and are having issues trying to come up with a schedule that fits both of them. They also financial issues going on that need to be solved.I also need to mention in the paper how it was when I got there and parking. So I had to pay for parking which was about 6 dollars and I parked on the third level. It was also raining that day so I clearly remember getting wet. Also in order to get there I had to cross the street and once I was in I had to pass through security which meant taking my heels and belt off. Once I was officially in the building I took an elevator to the 5th floor where I saw other students from the class. It was too many of us and one of the officers told us that it was going to get ugly in there and that we needed to leave because the court was small and it was going to get packed. I was disappointed because I drove almost an hour for nothing but when we were exiting the court room the officer told us to go to the 3rd floor with judge Green. So we all went and I it was the same size …. small room with less people. Same people assisting ( A judge, an officer, the two other females that sat in front of the judge…. they seem to be taking notes of everything and an old lady that let us know when break time was over). Also, the two parties were present with their lawyers or attorneys. The woman ( Kim) had a female lawyer did not get to catch her name, while Robinson(the ex husband) had a male lawyer.Now I will give you details about the case. So this had been pending since February, 2019 and dealt with citation of content of travel expenses. So the Kim had moved to Wyoming due to a job opportunity and took the children. So the father of the children traveled 24 times since 2016 to Wyoming to see them all the way from Atlanta, Kim was suppose to help him out with the traveling expenses I believe half of it she was suppose to cover it but she did not and now he wants her to pay her part. The problem is that he only provided aspired sheet of the travel expenses and not actual receipts so it does not count.Kim’s SIDEThey disputed over other issues like on page 2 – contact with the children, page 6 -weekly parenting time schedule 3rd and th of every week and summer 50/50. Kim the mother wanted her kids to be with her dad on the 3rd and 5th day of every week and half of summer with her and the other half with their father that way they won’t be moving too much and it won’t intervene with their lives as much. Her argument was that the kids are growing and her son who is 14 year old can get a job if he wished for. Also summer camps … kids couldn’t be part of them if they were constantly moving..so it was cleaner and with more consistency to stay at one place for half of the summer….Kim owes in medical expenses $786.60 cents and she has documents that show. On Abril, 2018 the son got cancer so she had to relocate to Denver for treatment for 6 days straight then she had to go back but flew back out to Denver to finish up the treatment.On June 28th, 2018 she moved back to GA with her daughter and son to the same area and same house they lived in before moving to Wyoming.Kim argues that Robinson was trying to get away from Judge Green by taking their issues to a different county and that he never recall him living in Dekalb.She also stated that her ex husband aka the other party wanted to be able to talk to his kids at any time through the cell phone and not being on speaker with their mom listening. Her issue with the proposal is the time and schedule. Jasmine who was 12 years old have gymnastics and Antonio the 14 year old was part of the magnet program.She also owes him 4,750.24 on soccer club from her son Antonio. Also his bus picks and drops him off at a Publix near Mr. RobinsonRobinson’s SIDERobinson’s lawyer stated that Robinson had the documents the other party was asking for 3 times already and that day was the 4th time. those documents are the “receipts” that are consider a spreadsheet in general.After she moved back to GA, Mr. Robinson filed against her in Dekalb county court and not in Marietta because at the time he was living in Dekalb county. He filed because he petition child support and citation content. In other words he wanted his money for the travel expenses and he wanted his kids to live with him because he believed they needed his help and also cause the son was still curing from cancer. Also for the center treatment for parent’s insurances paid .Mr. Robinson goes up to the chair and raises his right hand to swear that all he is going to say is nothing but the truth.He states that he works for AT&T and that the traveling issues started in 2016 when he started traveling to see his kids and ever since it’s been going on…… The other financial issue is when she started deduction expenses without his consent. For example the expenses for gymnastic for her duaghter. He has proof of the emails where it they send him the receipt of the expenses and he have showed them to the Kim the other party and she ignores them. Kim’s lawyer asks to examine the docs.Divided into 2 because of ORDER. Gymnastic Expenses had to be paid 50 and 50 but she did not reimbursh his money back.His travel expenses were 26,000 for the past 3 years she only helped with 700 dollars even though she need to help with 50%.She owes him about 8,000 dollars.so it was better at one place cleaner and with more consistency .HEALTH INSURANCE- since their son had cancer they deducted 700 dollars out of Kim’s health insurance every 3 months for his test and Robinson’s health insurance deductible had not been made. So she owes 3,000 dollars to the hospital.Mr. Robinson has United health care which he pays 100 more dollars per kid a month. His insurance paid in 2018 that’s why 2019 they only deducted from her insurance.When she moved back to GA she purchased another house closer to where he lives which is about 6 miles apart which makes it easier for him to pick up the kids from school and bus stop for Antonio and drop them off in the morning. Since Antonio must be at the bus stop at 7:00 am and Jasmine at 8:30. He is an engineer so he goes in a few minutes after dropping his kids off. So there’s no problem with the schedule. He also states he wants to spend more time with his son because his grades are dropping and he wants to have more time to go over school work with him because both parents want him to go to a good College.HOLIDAY ISSUES – so they agreed to to take turn on holidays and birthdays but Kim would usually end up having them on the holidays. For Jasmine’s birthday Nov, 8th 2017 … he shoed up in Wyoming and waited 3 hours for Kim to open the door for him. So he wants to file a consent for not following the Order. Also he wants to file a consent for not letting him where the Kids go to events in Wyoming or if they have sleep overs somewhere where it’s not their mother’s houses .. he wishes to know.AGREEMENT – They both decide not to reimburse each other but she had access to his medical insurance and all he got was a card so that’s a problem, although they both agreed to use both insurances to pay children healthcare for the cancer stuff.Kim’s party fail to show page 2.1 of the issues before court to the other party so now that’s another issue. Supposedly by Kim’s lawyer it was the same document shown before but opposite side.Page 3 &4 – Says Mr.Robinson is responsible for extracurricular expenses and gymnastic and booster club. But Kim did not not show any proof of the expenses .. only some were sent to him thru email by the clubs.15 MINUTE BREAK STATED BY JUDGE GREEN.Both parties basically stated what they both wanted and the JUDGE SAID THIS COURT CASE SHOULD BE AVOIDED IN THE FUTURE BECAUSE IT IS WASTE OF MONEY AND TIME. THEY ARE SMART PARENTS AND SHOULD COME TO A CONCLUSION ON THEIR OWN. SO HE ORDERED COTACT WITH THE CHILDREN TO BE WEEKLY VISITATION WITH THE FATHER THURSDAYS AND FRIDAYS , HE COULD PICK THEM UP AFTER SCHOOL THURSDAY AND WHEN THER’S NO SCHOOL AT 9;AM EVERY THURSDAY. AND PRIVATE PHONE CALLS. FOR THE SUMMER HE SAID THAT A WEEK EACH PARENT SHOULD BE AS OF ODER DURING THE SUMMER.FOR THE HEALTH INSURANCE SHE IS THE RESPONSIBLE PARTY. AND FOR FREES TRAVEL AND OTHER FEES – NO CONTENT.ATTORNEY FEES- EACH DEFENDENT PAY THEIR LAWYERS.THANKSGIVING 2019 HIS FATHER GETS TO SPEND IT WITH THEM.CHILD SUPPORT- FROM BOTH PARENTS UNTIL KIDS REACH 18 YEARS OLD.EXTRACURRICULAR – EACH PARTY PAYS 50/50 ON EXPENSESHE ALSO GETS TO HAVE THEM FOR Father’s Day.The student should begin by making notes on any preconceived ideas and perceptions about the observations, such as:What does the student expect to see?What does the student expect to learn?What is the emotional reaction to entering the place of observation, asking for information, riding the elevator, entering the building, listening to others, or engaging with the officials, parties, attorneys, judges, participants, or mediators?For example, if you are observing a court proceeding:What did you think a courthouse or court would look like?What about entering the courthouse and finding the courtroom?What about the size of the courtroom and the court personnel present?What was the judge like? Was the judge fair? Was the judge involved?Were the attorneys competent? Did the “truth” come out?Was “justice” served?In the observation report, the student should:Include the student’s background. What does the student “bring to the table” and why the student chose their particular observation.Describe the experience objectively and subjectively.Analyze the experience with an eye toward personal growth, academic enhancement and civic engagement.Articulate the learning to the student’s academic career and personal goals.Comments such as “I enjoyed this assignment”, “I learned a lot”, “Thank you for requiring this project”, or words to that effect have little meaning without substantial and thorough explanation.“Dot connecting”—The observant student will understand and write about the “dot connecting” in the student’s life, the observation itself, the concepts taught in class, and the resulting learning experience. First person writing is acceptable.In short, the observation report should consist of 3 main parts:what does the student “bring to the table”the observation itself“dot-connecting” and what the student learned from the observation
